According to the Georgian law in case of the child born by a surrogate mother the couple and not the surrogate mother will be registered as the parents of the child. Even in case an embryo obtained from an egg or spermatozoon which was obtained not from the infertile couple but from a donor is transferred into the uterus of the surrogate mother, the couple will be deemed as the legal parents of the child. The birth certificate will be issued after the child birth. The couple will be registered as the parents in the birth certificate Thus a birth certificate of the child born by a surrogate mother does not differ from the birth certificate of any other children. Consent of the surrogate mother is not required for registration of the infertile couple as parents. The following will be required for registration of the couple as parents: Surrogacy Agreement made by the couple, certificate of embryo transfer into the uterus of the surrogate mother issued by the IVF clinic and certificate of the fact of childbirth issued by maternity hospital. The procedure of issuance of the birth certificate is simple and does not require hiring a lawyer.
Fertilization with donor sperm is permitted:
a) Owing to infertility, existence of the risk of genetic diseases inheritance on a husband’s part or for fertilization of a single woman, if has been obtained a written consent of an infertile couple or a single woman. In case of a child’s birth an infertile couple or a single woman are considered to be parents, with ensuing responsibility and authorities. Donor is not entitled to be recognized a father of a child born in the issue of the fertilization;
b) Withdrawn (21.07.2010. N3553, shall come into operation from 1 December 2010);
1. Extracorporal fertilization is permitted:
a) For the purpose of infertility treatment, also, if exists the risk of genetic diseases inheritance on a wife’s or a husband’s part, with use of sex cells of a couple or a donor or an embryo, if has been obtained a written consent of a couple;
b) If a woman does not have the uterus, by means of transfer of the embryo obtained in the issue of fertilization into the uterus of any other woman (surrogate mother) and its growth. Written consent of the couple is mandatory;
For the purpose of artificial fertilization it is possible to use a female and male sex chromosomes or an embryo preserved by freezing method. Preservation time is defined by a couple’s wish, in the established order.
